The Supreme Court considers whether the statutory provisions of the EQC Act apply to a contract of insurance

In Firm P1 Ltd v Zurich Australian Insurance Limited the SC considered whether the statutory provisions of the EQC act applied to a contract of insurance. The Court held, in a 3 to 2 majority, that the statutory provisions did apply and the insurer was required to pay the difference between the amount received from EQC and the sum insured.
