In the decision in Osborne v Auckland Council [2012] NZSC 199 the Court of Appeal confirmed that there is no second right of appeal from a decision of the Weathertight Homes Tribunal in a leaky homes case. The Court said that s95(2) of the WHRS Act 2006 limited a leaky home case in the WHT to one appeal.
