In the decison in Marlborough District Council v Altimarloch Joint Venture Ltd & ors [2012] NZSC 11 the Supreme Court confirmed that if a Council negligently gives erroneous information in a LIM and the recipient relies on the information to its detriment the Council will be liable for the loss their negligence has caused.
